This Terms of Use Agreement ("Agreement") governs Your use of idhiyaan.org ("Web Site"), a membership community platform operated by Idhiyaan Handicrafts Private Limited, a company incorporated under the Companies Act, 2013, with its registered office at 26/2 International Market, Sevoke Road, Siliguri 734001, West Bengal, India. The platform facilitates connections among handicrafts artisans, suppliers, and buyers. The expressions “You,” “Your,” or “User(s)” refer to any person who accesses or uses the Web Site for any purpose, including browsing, viewing member profiles (e.g., idhiyaan.org/member_name), or contacting members via provided details (e.g., WhatsApp, Instagram).
Intermediary Status and Safe Harbour Disclaimer: Idhiyaan Handicrafts Private Limited ("Idhiyaan") operates as an intermediary under Section 2(1)(w) of the Information Technology Act, 2000 ("IT Act") and claims safe harbour protection under Section 79 of the IT Act and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 ("IT Rules 2021"). Idhiyaan is a passive host of third-party content, including member profiles hosted at idhiyaan.org/member_name, which are published based solely on information provided by members without verification by Idhiyaan. Idhiyaan does not endorse, verify, or assume liability for any content, claims, products, services, or transactions arising from member profiles or interactions facilitated through the Web Site, including contacts made via WhatsApp, Instagram, or other provided details. Users engage with members at their sole risk, and Idhiyaan disclaims all liability for such interactions or transactions under applicable Indian laws.
By accessing or using the Web Site, including browsing member profiles or contacting members, You undertake and agree that You have fully read, understood, and accepted this Agreement. If You do not agree to or do not wish to be bound by this Agreement, You must not access or use the Web Site in any manner.
I. WEBSITE - MERELY A VENUE/PLATFORM
The Web Site serves as a platform to connect User(s) with members (handicrafts artisans, suppliers, or buyers) by hosting unverified member profiles (e.g., idhiyaan.org/member_name). Idhiyaan facilitates connections by displaying contact details (e.g., WhatsApp, Instagram) provided by members, enabling User(s) to interact directly with them. Idhiyaan is not a party to any negotiations, communications, or agreements (including for the sale or supply of goods or services) concluded between User(s) and members.
Idhiyaan does not control and is not liable for or responsible for the quality, safety, genuineness, lawfulness, or availability of products or services offered by members, nor for the ability of members to complete a sale or User(s) to complete a purchase. Member profiles are based solely on information provided by members, and Idhiyaan does not verify their credentials, authenticity, or claims. User(s) contacting members via WhatsApp, Instagram, or other provided details do so at their own risk, and Idhiyaan is not responsible for any outcomes, disputes, or transactions arising from such interactions. This Agreement does not create any partnership, joint venture, agency, or other business relationship between Idhiyaan and any User(s) or members. As an intermediary under Indian laws, Idhiyaan is not liable for User-generated or member-provided content or any transactions facilitated through the Web Site.
II. SERVICES PROVIDED BY IDHIYAAN
Idhiyaan provides the following services:
Community Access: Free access for User(s) to browse unverified member profiles and contact members using provided details (e.g., WhatsApp, Instagram).
Paid Membership: Members in the handicrafts business can obtain a dedicated profile (e.g., idhiyaan.org/member_name) to showcase their products, services, and contact information, increasing visibility within the community.
Verified Contact Details: Idhiyaan may verify primary/secondary mobile or email details to designate members as "Verified" for contact purposes only. Idhiyaan does not verify business credentials, authenticity, or any other claims in member profiles.
III. USER(S) ELIGIBILITY
User(s) represent and warrant that they have the legal capacity to use the Web Site under applicable Indian laws, including the IT Act and IT Rules 2021. Only individuals or business entities (including sole proprietorships, companies, and partnerships) authorized to form legally binding agreements may use the Web Site. Natural persons under 18 years of age and entities not authorized to operate in India are not eligible to use Idhiyaan Services.
User(s) agree to comply with this Agreement, the IT Act, IT Rules 2021, the Digital Personal Data Protection Act, 2023 ("DPDP Act"), and all applicable Indian laws. Idhiyaan is not liable for any content, information, or material displayed on the Web Site, including fraudulent, untrue, misleading, inaccurate, defamatory, offensive, or illicit material in member profiles. The risk of damage from such material rests entirely with User(s). User(s) must conduct their own due diligence before contacting or transacting with members. Idhiyaan reserves the right to restrict access to the Web Site or remove content at its sole discretion without notice. Idhiyaan Services are not available to User(s) or members whose access has been suspended or terminated.
IV. USER(S) AGREEMENT
This Agreement applies to all User(s) accessing the Web Site for any purpose, including browsing or contacting members. User(s) may use the Web Site solely for exploring handicrafts-related connections. User(s) are prohibited from transferring, sublicensing, or assigning any rights related to Idhiyaan Services without prior written consent from Idhiyaan.
This Agreement governs all services offered on the Web Site, along with any additional terms applicable to specific services. In case of conflict, additional terms prevail. This Agreement supersedes any prior agreements between Idhiyaan and User(s) regarding Web Site use.
V. AMENDMENT TO AGREEMENT
Idhiyaan may amend this Agreement at any time, with changes effective immediately upon posting on the Web Site in English and Hindi (or other Eighth Schedule languages upon request). User(s) will be notified annually of these terms and Idhiyaan’s right to terminate access for non-compliance, per Rule 3(1)(c) of IT Rules 2021. If You do not agree to amended terms, You must stop using the Web Site immediately. Continued use signifies acceptance.
VI. INTELLECTUAL PROPERTY RIGHTS
Idhiyaan Handicrafts Private Limited is the sole owner or lawful licensee of all rights to the Web Site and its content ("Web Site Content"), including design, layout, text, images, graphics, sound, and video, excluding member-provided content. Web Site Content embodies trade secrets and intellectual property rights protected under Indian laws (e.g., Copyright Act, 1957; Trade Marks Act, 1999) and international laws. All title, ownership, and intellectual property rights remain with Idhiyaan, its affiliates, or licensors.
All rights not claimed herein are reserved by Idhiyaan. Information in member profiles ("Member Content") is provided by members without verification, and User(s) accept full responsibility for liabilities arising from reliance on such content. Idhiyaan does not warrant the accuracy, reliability, or quality of Member Content or products/services offered by members.
Member Content is hosted “as is” without guarantees of completeness, accuracy, timeliness, or results, and without warranties of performance, merchantability, or fitness for a particular purpose. Idhiyaan is not liable for any direct, indirect, incidental, punitive, or consequential damages related to Member Content or transactions. User(s) rely on Member Content at their sole risk. Idhiyaan respects third-party rights and does not infringe their copyrights or businesses, and may remove or correct errors in Member Content at its discretion to comply with Indian laws.
Trademark
"idhiyaan.org" and related icons/logos are registered trademarks or service marks of Idhiyaan Handicrafts Private Limited, protected under Indian intellectual property laws. Unauthorized copying, modification, use, or publication is prohibited.
Copyright
Web Site Content, excluding Member Content, is copyrighted to Idhiyaan. User(s) may not use third-party trademarks or content without prior written approval from owners. Idhiyaan is not an arbiter of intellectual property disputes and does not verify members’ rights to offer products/services. User(s) may report suspected infringements to na@idhiyaan.org. Removing content does not imply endorsement of infringement claims, nor does retaining content imply endorsement of legality. User(s) must not copy, download, or reproduce Web Site Content for resale, redistribution, or competing purposes without permission. Systematic retrieval of content is prohibited. Unauthorized use may lead to legal action under the Copyright Act, 1957, or other laws.
Idhiyaan may terminate access for infringing third-party rights or prejudicial conduct, per Rule 3(1)(d) IT Rules 2021.

URLs or sub-domains (e.g., idhiyaan.org/member_name) are Idhiyaan’s property and may be suspended, terminated, or edited without notice. Idhiyaan is not liable for damages, including lost profits or business interruption, arising from such actions.
VII. LINKS TO THIRD-PARTY SITES
Links to third-party sites (e.g., WhatsApp, Instagram) in member profiles are provided for convenience. Idhiyaan has no control over such platforms and is not liable for their content, privacy practices, or services. User(s) should review third-party terms and policies before use. Idhiyaan disclaims liability for interactions or transactions conducted via third-party platforms.
VIII. TERMINATION
Idhiyaan may terminate or restrict access to the Web Site or remove Member Content at any time without notice to protect its interests or comply with Indian laws (e.g., IT Rules 2021, Rule 3(1)(d)). Termination may occur for:
(a) Providing false or fraudulent Member Content.
(b) Breaching this Agreement or applicable laws.
(c) Posting non-handicrafts-related content.
(d) Impersonating another person/entity.
(e) Unauthorized access or misuse of Web Site systems.
(f) Unethical or unlawful conduct.
No membership fees will be refunded upon termination, though Idhiyaan may, at its discretion, process pro-rata refunds for discontinuations not due to the above, after adjusting charges. Idhiyaan is not liable for damages arising from inability to use the Web Site or termination.
IX. MEMBER CONTENT AND USER INTERACTIONS
Idhiyaan hosts unverified member profiles to facilitate connections. User(s) may contact members via provided details (e.g., WhatsApp, Instagram) at their own risk. Idhiyaan does not participate in, verify, or endorse such communications or transactions.
Due Diligence and Prohibited Content:
As an intermediary, Idhiyaan observes due diligence under Rule 3(1) of IT Rules 2021 to maintain safe harbour under Section 79 IT Act. User(s) and members are notified in English and Hindi (or other Eighth Schedule languages upon request) that the following content is prohibited in member profiles:
(a) Content belonging to another without permission.
(b) Infringing intellectual property rights (Copyright Act, 1957; Trade Marks Act, 1999).
(c) Defamatory, obscene, pornographic, or privacy-violating content (IT Act Section 67; IPC Section 292).
(d) Threatening India’s sovereignty, security, or public order (IT Rules 2021, Rule 3(1)(b)(i)).
(e) Promoting hate speech, discrimination, or violence (IPC Sections 153A/295A).
(f) Misinformation, fraud, or counterfeit offers (Consumer Protection Act, 2019).
(g) Child exploitation, narcotics, or prohibited goods (POCSO Act, 2012; NDPS Act, 1985).
(h) Viruses or disruptive code (IT Act Section 66).
(i) Harassment, impersonation, or unlawful solicitation.
(j) Violations of export controls, anti-discrimination, or advertising laws.
(k) Unauthorized disclosure of personal data (DPDP Act, 2023).
(l) Gambling, money laundering, or cybercrimes (PMLA, 2002).
(m) Content inciting offenses or threatening public safety.
(n) Links to prohibited sites/services.
(o) Abetting infringement or illegal activities.
(p) Patently false, menacing, or harmful content.
(q) Invasive of privacy or encouraging crimes.
(r) Competing with Idhiyaan unlawfully.
(s) Insulting nations or obstructing investigations.
(t) Damaging systems or expropriating data.
(u) Promoting weapons or banned items.
(v) Vulgar, seditious, blasphemous, or pedophilic content.
(w) Breaching confidence or otherwise unlawful.
(x) Unauthorized ads or harassment.
(y) Any content violating Indian laws.
Idhiyaan will remove prohibited content within 36 hours (24 hours for sexual content) upon actual knowledge via court order, government notification (Section 79(3)(b) IT Act), or complaint to na@idhiyaan.org. Members warrant that their content is true, non-infringing, and compliant. User(s) and members indemnify Idhiyaan for breaches. Idhiyaan notifies User(s) and members annually of these rules and its right to remove content or terminate access for non-compliance (Rule 3(1)(c)).
Members grant Idhiyaan a perpetual, worldwide, royalty-free, sublicensable license to host and display their content for platform purposes, subject to compliance with Indian laws. Idhiyaan may remove content deemed unlawful or inappropriate without liability.
X. INTERACTION BETWEEN USERS AND MEMBERS
Idhiyaan facilitates connections by hosting unverified member profiles with contact details (e.g., WhatsApp, Instagram). Idhiyaan does not represent User(s) or members, charge commissions, or participate in transactions. Idhiyaan is not liable for the quality, safety, lawfulness, or availability of products/services or the ability of parties to complete transactions. User(s) are cautioned that member profiles are unverified, and interactions via third-party platforms carry risks. Idhiyaan uses tools to verify contact details but does not confirm identities or credentials.
User(s) assume all Transaction Risks, including misrepresentation, fraud, defective products, delays, or intellectual property violations. Idhiyaan is not liable for damages, liabilities, or costs arising from interactions or transactions, including those via WhatsApp or Instagram. User(s) are responsible for all transaction terms (e.g., payment, warranties). User(s) agree to release and indemnify Idhiyaan, its affiliates, directors, officers, and employees from all claims, demands, costs, and damages arising from such interactions, per Section 79 IT Act.
XI. LIMITATION OF LIABILITY/DISCLAIMER
Idhiyaan Services are provided “as is” and “as available,” with no warranties of condition, quality, durability, performance, accuracy, reliability, merchantability, or fitness for a particular purpose. Idhiyaan does not warrant the validity, accuracy, or completeness of Member Content or products/services offered. User(s) access content or contact members at their own risk and are responsible for damages (e.g., system damage from downloads).
Idhiyaan is not liable for disruptions due to acts of nature, technical failures, or third-party actions. User(s) indemnify Idhiyaan from losses, claims, or liabilities arising from Web Site use, Agreement breaches, or third-party rights claims (e.g., IP infringement). Idhiyaan is not responsible for Member Content or damages therefrom, including unverified profiles or third-party platform interactions. As an intermediary under Section 79 IT Act and IT Rules 2021, Idhiyaan is not liable for third-party content or transactions unless it fails to comply with legal orders.
Idhiyaan is not liable for any damages, including loss of profits, business interruption, or information loss, arising from:
Web Site use or inability to use.
Defects in goods/services obtained via member contacts.
Third-party rights violations.
Unauthorized access to data.
Member/User conduct.
Issues with membership services.
XII. GRIEVANCE REDRESSAL MECHANISM
Idhiyaan appoints Nikhil Agarwal as Grievance Officer under Rule 4 IT Rules 2021. Complaints regarding Member Content, interactions, or violations must be sent to na@idhiyaan.org with details (e.g., profile URL, issue). Idhiyaan acknowledges complaints within 24 hours and resolves them within 15 days. Unresolved complaints may be escalated to an Oversight Committee. Monthly compliance reports are published on the Web Site. User(s) may report unlawful content, and Idhiyaan will act per Rule 3(1)(d) to maintain safe harbour.
XIII. NOTICES
Notices to Idhiyaan must be sent to 26/2 International Market, Sevoke Road, Siliguri 734001, West Bengal, India, or na@idhiyaan.org. Notices to User(s) will be posted on the Web Site or sent to provided contacts. Notices are deemed received when sent or posted.
XIV. GOVERNING LAW AND DISPUTE RESOLUTION
This Agreement is governed by Indian laws, with exclusive jurisdiction in the courts of Siliguri, West Bengal, India.
XV. MISCELLANEOUS
Section headings are for reference only. Idhiyaan’s failure to enforce rights does not waive them. Idhiyaan may assign its obligations. Invalid provisions do not affect others. Calls to +919741690920 may be recorded for quality purposes. Idhiyaan’s intermediary status under Section 79 IT Act and IT Rules 2021 ensures no liability for hosted content or transactions.

This Agreement constitutes the entire agreement between User(s) and Idhiyaan, superseding prior agreements.

IX. MEMBER CONTENT AND USER INTERACTIONS
Idhiyaan hosts unverified member profiles to facilitate connections. User(s) may contact members via provided details (e.g., WhatsApp, Instagram) at their own risk. Idhiyaan does not participate in, verify, or endorse such communications or transactions.
Due Diligence and Prohibited Content:
As an intermediary, Idhiyaan observes due diligence under Rule 3(1) of IT Rules 2021 to maintain safe harbour under Section 79 IT Act. User(s) and members are notified in English and Hindi (or other Eighth Schedule languages upon request) that the following content is prohibited in member profiles:
(a) Content belonging to another without permission.
(b) Infringing intellectual property rights (Copyright Act, 1957; Trade Marks Act, 1999).
(c) Defamatory, obscene, pornographic, or privacy-violating content (IT Act Section 67; IPC Section 292).
(d) Threatening India’s sovereignty, security, or public order (IT Rules 2021, Rule 3(1)(b)(i)).
(e) Promoting hate speech, discrimination, or violence (IPC Sections 153A/295A).
(f) Misinformation, fraud, or counterfeit offers (Consumer Protection Act, 2019).
(g) Child exploitation, narcotics, or prohibited goods (POCSO Act, 2012; NDPS Act, 1985).
(h) Viruses or disruptive code (IT Act Section 66).
(i) Harassment, impersonation, or unlawful solicitation.
(j) Violations of export controls, anti-discrimination, or advertising laws.
(k) Unauthorized disclosure of personal data (DPDP Act, 2023).
(l) Gambling, money laundering, or cybercrimes (PMLA, 2002).
(m) Content inciting offenses or threatening public safety.
(n) Links to prohibited sites/services.
(o) Abetting infringement or illegal activities.
(p) Patently false, menacing, or harmful content.
(q) Invasive of privacy or encouraging crimes.
(r) Competing with Idhiyaan unlawfully.
(s) Insulting nations or obstructing investigations.
(t) Damaging systems or expropriating data.
(u) Promoting weapons or banned items.
(v) Vulgar, seditious, blasphemous, or pedophilic content.
(w) Breaching confidence or otherwise unlawful.
(x) Unauthorized ads or harassment.
(y) Any content violating Indian laws.
Idhiyaan will remove prohibited content within 36 hours (24 hours for sexual content) upon actual knowledge via court order, government notification (Section 79(3)(b) IT Act), or complaint to na@idhiyaan.org. Members warrant that their content is true, non-infringing, and compliant. User(s) and members indemnify Idhiyaan for breaches. Idhiyaan notifies User(s) and members annually of these rules and its right to remove content or terminate access for non-compliance (Rule 3(1)(c)).
Members grant Idhiyaan a perpetual, worldwide, royalty-free, sublicensable license to host and display their content for platform purposes, subject to compliance with Indian laws. Idhiyaan may remove content deemed unlawful or inappropriate without liability.
X. INTERACTION BETWEEN USERS AND MEMBERS
Idhiyaan facilitates connections by hosting unverified member profiles with contact details (e.g., WhatsApp, Instagram). Idhiyaan does not represent User(s) or members, charge commissions, or participate in transactions. Idhiyaan is not liable for the quality, safety, lawfulness, or availability of products/services or the ability of parties to complete transactions. User(s) are cautioned that member profiles are unverified, and interactions via third-party platforms carry risks. Idhiyaan uses tools to verify contact details but does not confirm identities or credentials.
User(s) assume all Transaction Risks, including misrepresentation, fraud, defective products, delays, or intellectual property violations. Idhiyaan is not liable for damages, liabilities, or costs arising from interactions or transactions, including those via WhatsApp or Instagram. User(s) are responsible for all transaction terms (e.g., payment, warranties). User(s) agree to release and indemnify Idhiyaan, its affiliates, directors, officers, and employees from all claims, demands, costs, and damages arising from such interactions, per Section 79 IT Act.
XI. LIMITATION OF LIABILITY/DISCLAIMER
Idhiyaan Services are provided “as is” and “as available,” with no warranties of condition, quality, durability, performance, accuracy, reliability, merchantability, or fitness for a particular purpose. Idhiyaan does not warrant the validity, accuracy, or completeness of Member Content or products/services offered. User(s) access content or contact members at their own risk and are responsible for damages (e.g., system damage from downloads).
Idhiyaan is not liable for disruptions due to acts of nature, technical failures, or third-party actions. User(s) indemnify Idhiyaan from losses, claims, or liabilities arising from Web Site use, Agreement breaches, or third-party rights claims (e.g., IP infringement). Idhiyaan is not responsible for Member Content or damages therefrom, including unverified profiles or third-party platform interactions. As an intermediary under Section 79 IT Act and IT Rules 2021, Idhiyaan is not liable for third-party content or transactions unless it fails to comply with legal orders.
Idhiyaan is not liable for any damages, including loss of profits, business interruption, or information loss, arising from:
Web Site use or inability to use.
Defects in goods/services obtained via member contacts.
Third-party rights violations.
Unauthorized access to data.
Member/User conduct.
Issues with membership services.
XII. GRIEVANCE REDRESSAL MECHANISM
Idhiyaan appoints Nikhil Agarwal as Grievance Officer under Rule 4 IT Rules 2021. Complaints regarding Member Content, interactions, or violations must be sent to na@idhiyaan.org with details (e.g., profile URL, issue). Idhiyaan acknowledges complaints within 24 hours and resolves them within 15 days. Unresolved complaints may be escalated to an Oversight Committee. Monthly compliance reports are published on the Web Site. User(s) may report unlawful content, and Idhiyaan will act per Rule 3(1)(d) to maintain safe harbour.
XIII. NOTICES
Notices to Idhiyaan must be sent to 26/2 International Market, Sevoke Road, Siliguri 734001, West Bengal, India, or na@idhiyaan.org. Notices to User(s) will be posted on the Web Site or sent to provided contacts. Notices are deemed received when sent or posted.
XIV. GOVERNING LAW AND DISPUTE RESOLUTION
This Agreement is governed by Indian laws, with exclusive jurisdiction in the courts of Siliguri, West Bengal, India.
XV. MISCELLANEOUS
Section headings are for reference only. Idhiyaan’s failure to enforce rights does not waive them. Idhiyaan may assign its obligations. Invalid provisions do not affect others. Calls to +919741690920 may be recorded for quality purposes. Idhiyaan’s intermediary status under Section 79 IT Act and IT Rules 2021 ensures no liability for hosted content or transactions.

This Agreement constitutes the entire agreement between User(s) and Idhiyaan, superseding prior agreements.
